The court held that the taxing master generally applied the correct principles and properly taxed items 1 to 9 of the advocate-client bill of costs. However, in respect of item 10, the taxing master failed to apply the correct rate under schedule V paragraph 4 of the Advocates Remuneration Order, resulting in an under-assessment. The court recalculated item 10 and taxed it at Kshs 107,334 instead of Kshs 12,000. The total bill was thus revised to Kshs 312,534. The court found no basis to remit the bill for re-taxation or to interfere with the other taxed items, as the taxing master exercised her discretion within the law and relevant principles.
