Criminal Revision / Ruling on Application for Revision of Sentence

  1. 1 Whether the High Court has jurisdiction to review its own decision on sentence after an appeal has been determined.
  2. 2 Whether the applicant can seek revision of sentence after his appeal was dismissed by the High Court.

Ratio Decidendi

The High Court lacks jurisdiction to review its own decision on sentence after an appeal has been determined. The powers of revision under Article 165 of the Constitution and sections 362 and 364 of the Criminal Procedure Code are limited to decisions of subordinate courts. Since the applicant's appeal against conviction and sentence was already heard and dismissed by the High Court, the applicant cannot seek a further review of sentence before the same court. The only available recourse after dismissal of an appeal is to approach the Court of Appeal. The application for revision is therefore incompetent and must be dismissed for want of jurisdiction.
