The High Court held that the trial magistrate erred in exercising discretion by conditioning the setting aside of the ex parte judgment and leave to defend on the deposit of the full decretal sum. The court reasoned that once an ex parte judgment is set aside, the suit reverts to its original status and the issue of a decretal sum does not arise, as the matter must be heard afresh and the sum may change. The only permissible condition for setting aside is the payment of throwaway costs, not the deposit of the decretal sum.
