Procedural Posture

Environment and Land Appeal / Judgment

  1. 1 Whether the appellant had locus standi to institute and prosecute the suit concerning the deceased's estate.
  2. 2 Whether a beneficiary requires a limited grant of letters of administration ad litem to sue an administrator or co-beneficiary where a full grant already exists.
  3. 3 Whether the trial magistrate erred in dismissing the suit for want of locus standi and in ordering the appellant to pay accumulated mortuary charges.

Ratio Decidendi

The court held that the appellant, as an undisputed beneficiary of the deceased's estate, was entitled to seek protection of estate assets and to challenge actions by the administrator or co-beneficiaries without the need for a limited grant of letters of administration ad litem, where a full grant had already been issued. The requirement for a limited grant is not mandatory in disputes between beneficiaries or between a beneficiary and an administrator, as the purpose of such a grant is to identify beneficiaries and enable urgent action where no grant exists. The trial magistrate erred in dismissing the suit for want of locus standi and in ordering the appellant to pay mortuary charges....
