Ratio Decidendi

The court held that no leave to appeal was required against the ruling of the Subordinate Court delivered on 8th February 2024, as the order was made under Order 40 rule 3 of the Civil Procedure Rules, which is expressly appealable as of right under Order 43 rule 1 (u). Even if leave were necessary, it should have been sought before the Subordinate Court. The court further found that the applicants had not filed any appeal, and therefore, there was no basis for granting a stay of execution pending appeal. Granting a stay in the absence of a filed appeal would be improper and open to abuse. Consequently, the application for stay and leave to appeal was dismissed with costs to the respondent.
