Ratio Decidendi

The court found that no leave to appeal was required against the ruling delivered by the Subordinate Court on 8th February 2024 because the order was made under Order 40 rule 3 of the Civil Procedure Rules, which is expressly appealable as of right under Order 43 rule 1 (u). Even if leave were necessary, it should have been sought before the Subordinate Court within the prescribed period. The court further held that the applicants had not filed any appeal, and therefore, there was no basis for granting a stay of execution pending appeal. Granting a stay in the absence of an existing appeal would be contrary to the requirements of Order 42 rule 6 and could lead to abuse of court process....
