Ratio Decidendi

The court found that the deponent of the supporting affidavit, Beatrice Waweru, did not annex any authority or board resolution authorizing her to swear the affidavit on behalf of the applicant company. The court held that failure to comply with the requirement to provide such authority is not curable under Article 159(2)(d) of the Constitution. As a result, the supporting affidavit was declared incompetent and struck out. In the absence of a competent supporting affidavit, the application for leave to appeal out of time was found to be defective and was accordingly struck out with costs to the respondent.
