Upon expiry, the tenant became a trespasser and was obligated to give vacant possession. The Tribunal held that it retains jurisdiction to order recovery of possession and arrears of rent under section 12(1)(e) of Cap 301, even where the tenancy has expired. The tenant's application for injunctive relief was dismissed as she no longer had a protected tenancy. The landlord's application for distress for rent and eviction was allowed, as the tenant was found to be in arrears and in unlawful occupation.
