Ratio Decidendi

The High Court lacks jurisdiction to reduce a sentence below the statutory minimum prescribed by Section 8(4) of the Sexual Offences Act. The trial court had already imposed a sentence of twelve years, which was below the lawful minimum of fifteen years, and this error was to the benefit of the applicant. The Supreme Court decision in Republic v Joshua Gichuki Mwangi is binding and divests the High Court of jurisdiction to interfere with or further reduce the impugned sentence. The application for review of sentence is therefore without merit and must be dismissed.
