The court found that the applicant had satisfactorily explained the delay in filing the notice of appeal, as the judgment was delivered without notice to the parties and was not made available on the e-filing portal. The applicant only became aware of the judgment upon being served with a bill of costs, after the time for filing a notice of appeal had lapsed. The facts were uncontested and the application was unopposed. The court exercised its discretion in favour of the applicant, holding that the delay was not inordinate, the explanation was reasonable, and no prejudice would be suffered by the respondent. The application for extension of time was therefore allowed.
