Ratio Decidendi

The High Court lacks jurisdiction to entertain the applicant's motion for revision of sentence because the sentence was already substituted by another High Court judge, and recent Supreme Court decisions have clarified that sentences imposed under Section 8 of the Sexual Offences Act are lawful and not subject to revision on the grounds advanced. The rationale in Muruatetu I does not extend to mandatory or minimum sentences for offences other than murder. Therefore, the application is struck out for want of jurisdiction.
