Procedural Posture

Constitutional Petition / Ruling on Application for Review of Sentence

  1. 1 Whether the High Court has jurisdiction to review a sentence already affirmed by the Court of Appeal.
  2. 2 Whether the Supreme Court decision in Muruatetu applies to the applicant's case.
  3. 3 Whether the applicant is entitled to a more lenient sentence or probation.

Ratio Decidendi

The High Court lacks jurisdiction to review a sentence that has already been affirmed by the Court of Appeal, as its review powers under the Criminal Procedure Code are confined to correcting errors on the face of its own record or errors by subordinate courts. Furthermore, the Supreme Court's decision in Muruatetu is inapplicable to the applicant's case because it only concerns mandatory death sentences in murder cases, whereas the applicant's conviction does not fall within that category. As such, the application for review of sentence is without merit and must be dismissed.
