The court found that the Applicant had instructed the firm of P M Mutuku and Company Advocates to act for him, and that the advocate had ostensible and general authority to withdraw the suit on his behalf. There was no evidence that the withdrawal was done fraudulently or contrary to express instructions. The law under Order 25 of the Civil Procedure Rules does not provide for reinstatement of a withdrawn suit, and withdrawal is complete and effective as soon as it takes place. The Applicant's remedy, if any, lies in instituting a fresh suit, not in seeking reinstatement.
