Ratio Decidendi

The court found that the Claimant was an employee of the Respondent, and that his termination was both substantively and procedurally unfair. The Respondent failed to provide any reason for the dismissal, did not give notice, warning, or a hearing, and did not participate in the proceedings to rebut the Claimant's evidence. The Employment Act places a heavy obligation on employers to justify termination and follow due process, which was not met. The court therefore held the dismissal to be unlawful and unfair, entitling the Claimant to one month’s salary in lieu of notice, annual leave for 7 years, and compensation for unfair termination equivalent to 10 months’ salary, as well as costs.
