Procedural Posture

Review Application / Ruling on Motion for Review After Notice of Appeal Filed

  1. 1 Whether the court can entertain a review application after a notice of appeal has been filed.
  2. 2 Whether the applicants admitted to receiving the amounts stated in the County Labour Officer's report.
  3. 3 Whether the application for review meets the threshold under section 80 of the Civil Procedure Act.

Ratio Decidendi

The court held that since the claimants had already lodged a notice of appeal against the ruling they sought to review, they could not simultaneously pursue a review application. The court adopted the Court of Appeal's position that a litigant must choose between review and appeal, and once an appeal is initiated, review is no longer available. The review application was therefore incompetent and constituted an abuse of the court process. The motion was dismissed with costs to the respondent.
