The absence of a notice of appeal did not, in the circumstances, preclude the grant of a stay, as justice required that the petitioner be given an opportunity to pursue his intended appeal before execution of the taxed costs. However, the stay was conditional upon the petitioner providing security for the taxed costs within forty-five days by depositing the amount in a joint interest-earning account.
