The court found that the Claimant was indeed employed by the Respondent, as evidenced by his election, secondment, and the Respondent's control over his employment. There was no credible evidence that the Claimant's salary was lawfully pegged to union membership or that he consented to any reduction. The Respondent's unilateral reduction of salary was therefore unlawful. The court accepted the Respondent's evidence of payments made but determined, after netting off the sums, that the Claimant was still owed Kshs. 207,131/- in salary arrears.
