The High Court found that the respondent, as a pillion passenger, could not have contributed to the accident and that her evidence, corroborated by PW2 and the police abstract, established negligence on the part of the appellant on a balance of probabilities. However, the trial court's award of general damages was found to be inordinately high and not supported by comparable authorities for similar injuries, which were soft tissue in nature and had healed without permanent incapacity. The High Court reduced the general damages to Kshs. 1,000,000. The claim for special damages was dismissed as the respondent failed to strictly prove the amounts claimed with proper receipts.
