Procedural Posture

Tribunal Reference / Judgment

  1. 1 Whether the landlord’s notice to terminate tenancy ought to be upheld or dismissed.
  2. 2 Whether the landlord is entitled to vacant possession and recovery of arrears from the tenant.
  3. 3 Who is liable to pay costs.

Ratio Decidendi

The tribunal found that the tenant was duly served with a tenancy termination notice but failed to file a reference opposing it within the statutory period. Ignorance of the law was not accepted as a defence. As a result, the notice took effect on June 1, 2021, and the tenant's continued occupation thereafter rendered him a trespasser. The landlord was therefore entitled to vacant possession of the premises and recovery of any outstanding rent arrears. The tribunal also found that the tenant had not paid rent for May and June 2022 by the hearing date and directed that all arrears be cleared by July 31, 2022. Costs were awarded to the landlord as the successful party.

Court Disposition

Landlord's reference allowed; tenancy terminated; vacant possession and arrears ordered; costs awarded to landlord.

Orders

  • The landlord’s tenancy notice dated 23/3/2021 is approved and the tenant’s occupation of the premises is terminated.
  • The tenant shall deliver vacant possession of the suit premises on or before July 31, 2022, failing which eviction shall be carried out by a licensed auctioneer with police security.
