The court held that it lacked jurisdiction as a single judge to deem the notice of appeal withdrawn, as this is a matter for a full bench. Furthermore, since the appeal had already been filed, the notice of appeal could not be deemed withdrawn under Rule 83. Regarding the application for leave to file an application to strike out the notice of appeal out of time, the court found that the applicant failed to explain the nine-month delay between granting the respondent indulgence and filing the current application. The unexplained delay was fatal to the exercise of the court's discretion in the applicant's favour. Consequently, the application was dismissed with costs.
