Procedural Posture

Sports Dispute Application / Final Decision

  1. 1 Whether the tribunal has jurisdiction to hear the petition.
  2. 2 Whether the issues raised regarding WASK elections are res judicata.
  3. 3 Whether the petitioner has provided sufficient evidence to bar the 2nd and 3rd respondents from acting on behalf of the 1st respondent.

Ratio Decidendi

The tribunal found that it had jurisdiction as the parties had submitted themselves to its authority. However, the issues concerning the WASK elections had already been determined in SDT SC No E10 of 2022, rendering the matter res judicata. The petitioner failed to provide evidence or material to justify barring the 2nd and 3rd respondents from acting on behalf of the 1st respondent or to warrant the constitution of a caretaker committee. The tribunal also found no basis for granting the other prayers sought, including refund of allowances or barring the respondents from contesting WASK elections. The petition was therefore dismissed for lack of merit.
