Order 43 of the Civil Procedure Rules further requires that leave to appeal must be sought and obtained in such circumstances. Since the appellant conceded that no leave had been sought or obtained, the court found that it lacked jurisdiction to entertain both the appeal and the application for stay. Consequently, both the appeal and the application were struck out as incompetent.
