Ratio Decidendi

The High Court found that it lacked jurisdiction to entertain the sentence review application because the applicant had already appealed the conviction and sentence, and the appellate court (High Court) had dismissed the appeal, upholding both conviction and sentence. The issue of sentence had been specifically raised and determined in the appeal. Furthermore, the applicant had indicated an intention to appeal to the Court of Appeal, where the issue of sentence could be canvassed. As such, the High Court was functus officio and could not review a sentence it had already upheld on appeal. The application was therefore incompetent and struck out.
