Procedural Posture

Criminal Revision / Ruling

  1. 1 Whether the applicant, serving a sentence for grievous harm, qualifies for a non-custodial sentence under the Chief Justice's decongestion memo.
  2. 2 Whether the applicant's conduct and remaining sentence justify conversion to community service.

Ratio Decidendi

The court found that the applicant, convicted of grievous harm and with only four months remaining on his sentence, had demonstrated remorse and receptiveness to rehabilitation. In line with the Chief Justice's directive on decongestion and based on the favourable probation report, the court determined that the applicant was suitable for a non-custodial sentence. Consequently, the custodial sentence was substituted with a three-month community service order at Baba Dogo Health Center, under probation supervision.

Court Disposition

Custodial sentence substituted with community service order.

Orders

  • The applicant is placed on community service for three months at Baba Dogo Health Center under the supervision of the Officer in Charge, Makadara Probation Station.
  • File closed.
