Despite the negative recommendation in the Sentence Revision Report regarding the applicant's suitability for a non-custodial sentence, the court considered the fact that the applicant had less than one month remaining on his custodial sentence. In the interest of prison decongestion and given the minimal time left to serve, the court ordered the applicant's immediate release from prison, subject to strict reporting conditions to the nearest police station for the remainder of his sentence.
