Procedural Posture

Criminal Revision / Ruling on Application for Sentence Revision

  1. 1 Whether the High Court has jurisdiction to revise or resentence where a court of concurrent jurisdiction has already determined the issue.
  2. 2 Whether the applicant's repeated application for resentencing constitutes an abuse of court process.

Ratio Decidendi

The court held that it has no jurisdiction to revise or resentence where a court of concurrent jurisdiction has already determined the issue. The applicant's previous petition for resentencing had been fully addressed by another High Court judge, who found that the trial court had complied with the relevant guidelines and considered the period served in custody. Article 165 of the Constitution and section 362 of the Criminal Procedure Code restrict the High Court's revisionary powers to orders of subordinate courts, not those of courts of equal status. Therefore, the present application was deemed an abuse of process and was dismissed in its entirety.

Court Disposition

Application dismissed as an abuse of process and for lack of merit.

Orders

  • The application for revision or resentencing is dismissed wholly.
