The court found that the Plaintiff failed to discharge the burden of proof required to establish that the transfer of the suit land from the deceased to the Defendant was irregular, unlawful, or void. The evidence showed that the land was transferred to the Defendant on 29th June 1992, during the lifetime of the deceased, and there was no evidence to suggest that the transfer was not effected by the deceased himself. As such, the property ceased to belong to the deceased before his death and could not form part of his estate. The Plaintiff, therefore, had no legal basis to seek cancellation of the Defendant's title or reversion of the land to the estate. The suit was dismissed for lack of...
