Procedural Posture

Miscellaneous Application / Ruling on Application to Convert Certificate of Costs Into Judgment and Decree

  1. 1 Whether the certificate of costs issued after taxation should be converted into a judgment and decree of the court.
  2. 2 Whether the judgment should reflect deductions for amounts already paid by the respondent.

Ratio Decidendi

The court held that since the advocate-client bill of costs had been taxed and a certificate of costs issued, the applicant was entitled to have the certificate converted into a judgment and decree as prayed. The only dispute raised by the respondent was that part of the taxed amount had already been paid, which is a matter of accounts and does not affect the applicant's right to judgment on the certificate. The court therefore entered judgment as per the certificate of costs, but directed that any payments already made by the respondent be taken into account before execution, with accounts to be taken before the Deputy Registrar or taxing officer.

Court Disposition

Judgment entered for the applicant as per the certificate of costs, subject to accounting for any payments already made by the respondent.

Orders

  • Judgment is entered as prayed for the applicant, based on the certificate of costs.
  • The amount to be paid shall take into account any payments already made by the respondent.
