The appellant failed to prove, on a balance of probabilities, that the respondent published the alleged defamatory statements or that the statements referred to him specifically. The evidence presented, being electronic records (screenshots), was inadmissible for lack of a certificate under section 106B of the Evidence Act. Furthermore, the pleadings did not set out particulars of defamation or the meaning a reasonable person would assign to the words. The trial court correctly found that the appellant did not meet the legal requirements for defamation, and there was no basis to interfere with its decision. The appeal was therefore dismissed with costs.
