Ratio Decidendi

The court found that the applicant was not served with the court's directions issued on 14/12/2021 because the registry failed to use the correct email address provided by the applicant's counsel. There was no evidence that the respondent's counsel served the applicant's counsel with the directions either. In the absence of proper service, the applicant could not be faulted for non-compliance. The court exercised its discretion to set aside the dismissal order of 25/1/2022 and reinstated the application dated 3/6/2021, subject to compliance with the original directions. Each party was ordered to bear its own costs.
