The court found that the applicant deposited the decretal sum in court not voluntarily but under compulsion of a court order as a condition for stay of execution. This deposit did not equate to payment to the decree-holder, and interest continued to accrue until the court ordered release of the funds to the respondent on 16th November 2015. Any execution or auctioneer action after the deposit was in bad faith, as all parties were aware the funds were held by the court.
