Procedural Posture

Miscellaneous Application / Ruling on Application to Set Aside Ex Parte Taxation and Ruling

  1. 1 Whether the application to set aside the ex parte taxation proceedings and ruling is properly before the court.
  2. 2 Whether the court has jurisdiction to entertain the application outside the procedure set by Rule 11 of the Advocates Remuneration Order.

Ratio Decidendi

The court determined that the application to set aside the ex parte taxation proceedings and ruling was not properly before it, as the correct procedure for challenging a taxing officer's decision is set out in Rule 11 of the Advocates Remuneration Order. The applicant failed to comply with this mandatory procedure, which requires giving notice of objection to the taxing officer and then applying by chamber summons. The court therefore lacked jurisdiction to entertain the application in its current form and declined to consider its merits. As a result, the application was struck out for being improperly before the court.
