Ratio Decidendi

The court found that the applicant failed to provide sufficient reasons for the delay in filing the application for leave to appeal out of time, as the impugned ruling was delivered on 9th October 2023 and the application was made six months later without adequate explanation. The court also noted that the respondent's contention that the decree was partially settled was not refuted by the applicant. Consequently, the court held that the application lacked merit and dismissed it. The subsequent application for stay of execution was also dismissed as it had been overtaken by events following the dismissal of the initial application.
