Procedural Posture

Environment and Land Appeal / Judgment

  1. 1 Whether the respondent's title to the suit property was lawfully and procedurally acquired.
  2. 2 Whether the appellant proved his counterclaim based on extended occupation and limitation of actions.
  3. 3 Whether the respondent's suit was statute-barred due to alleged prolonged occupation by the appellant.

Ratio Decidendi

The court found that the respondent's title to the suit property was irregularly obtained as it was transferred to him without conducting probate proceedings on the estate of the previous registered owner, Laurence Ochieng Amaunda, contrary to Section 45(1) of the Law of Succession Act. Although the appellant failed to prove adverse possession or extended occupation sufficient to bar the respondent's claim, the respondent's title was impeachable due to the lack of succession process. The court held that the register should be rectified to revert the property to Laurence's name pending proper probate. The appellant's occupation was deemed unlawful trespass, and he was ordered to vacate....

Court Disposition

Appeal allowed in part; trial court judgment substituted.
