The Tribunal found that while the termination notice was in the correct form and issued within the statutory period, the Landlady failed to provide sufficient evidence of a genuine intention to require vacant possession for reconstruction or other statutory grounds. The Landlady also failed to substantiate the claim of rent arrears or justify the alleged rent increase, as there was no evidence of a valid basis for increasing rent from Kshs. 15,000 to Kshs. 30,000, and the Tenant provided receipts for rent payments.
