Ratio Decidendi

The High Court lacks jurisdiction to hear and determine a criminal appeal filed out of time without leave of court. Section 349 of the Criminal Procedure Code mandates that appeals from the Magistrate's Court to the High Court be filed within 14 days, with the possibility of extension only upon application and grant of leave. The appellant filed the appeal 60 days after sentencing without seeking or obtaining such leave. Supreme Court authority confirms that documents filed out of time without leave are nullities and of no legal effect. The absence of an order granting leave to appeal out of time is fatal to the appeal. Consequently, the appeal is struck out for want of jurisdiction.
