The court found that the prosecution proved all elements of the offence of defilement beyond reasonable doubt. The complainant's testimony was credible and corroborated by medical and other evidence. The absence of certain witnesses did not undermine the prosecution's case, as their evidence would not have added value to the already corroborated testimony. The appellant's defence was a mere denial and was rightly dismissed in light of the prosecution's evidence. However, the sentence of life imprisonment was found to be harsh and excessive for a first offender, and the court substituted it with a sentence of twenty years imprisonment, effective from the date of conviction.
