Procedural Posture

Criminal Revision / Ruling on Sentence Review

  1. 1 Whether the applicant is entitled to a review of his custodial sentence to a non-custodial sentence.
  2. 2 What factors should guide the court in imposing a custodial or non-custodial sentence in cases of misdemeanour and first offenders.

Ratio Decidendi

The court found that the offence of stealing, for which the applicant was convicted, is a misdemeanour and that the applicant is a first offender who has demonstrated remorse and willingness to be rehabilitated. The probation report was positive and recommended a non-custodial sentence. The court held that, in light of these factors and the absence of any threat posed by the applicant to the community, a probation sentence for the remainder of the sentence period was appropriate. The court thus substituted the custodial sentence with a probation order for 8 months, subject to monthly compliance reports.

Court Disposition

custodial sentence substituted with probation order for 8 months

Orders

  • The applicant shall serve a probation sentence for the remaining period of 8 months.
  • Monthly reports shall be filed in court to ensure compliance.
