Legal Issues
- 1 Whether the applicant is entitled to a further reduction of sentence for the offence of defilement under the Sexual Offences Act.
Ratio Decidendi
The court found that there was no legal reason to further reduce the applicant's sentence, as the sentence had already been reduced from life imprisonment to 15 years on appeal. The statutory framework under the Sexual Offences Act prescribes minimum sentences for defilement, and the court is bound by these provisions. The applicant did not demonstrate any exceptional circumstances or legal grounds that would justify a further reduction. Accordingly, the application for further reduction of sentence was dismissed.
