Procedural Posture

Environment and Land Petition / Ruling on Oral Plea for Costs Following Amendment of Petition

  1. 1 Whether Rev Peter Kaminju Karanja, not being a party to the petition, is entitled to an award of costs following amendment of the petition.
  2. 2 Whether the court should exercise its discretion to award costs to a non-party under the Constitution of Kenya (Protection of Rights and Fundamental Freedoms) Practice and Procedure Rules.

Ratio Decidendi

The court found that Rev Peter Kaminju Karanja was neither a party to the original petition nor to the amended petition, nor was he named as a respondent in the application for contempt orders. Appearance in the petition was made on behalf of the Full Gospel Church of Kenya, not on behalf of Rev Karanja. The mere fact that Rev Karanja received papers relating to the contempt application on behalf of the Church does not entitle him to costs. There is no legal basis for awarding costs to a person who was not a party to the proceedings. The oral plea for costs by Rev Peter Kaminju Karanja was therefore rejected.

Court Disposition

Oral plea for costs by Rev Peter Kaminju Karanja rejected.

Orders

  • No award of costs to Rev Peter Kaminju Karanja on the oral plea.
