The court found that the plaintiffs had proved their case on a balance of probabilities. The evidence established that the defendant sold the land to Aloyce Omachar, who in turn sold it to the plaintiffs with the defendant's knowledge and consent. The defendant executed transfer documents for one plot but unreasonably refused to do so for the second, despite having received full purchase price. The surveyor's report confirmed the existence and boundaries of the plots. The defendant's explanation for refusing to sign the second transfer was not credible, as the division of the original plot into two was supported by documentary evidence and the boundaries were identifiable on the ground....

  • A permanent injunction is issued restraining the defendant and his representatives from entering, evicting, disposing of, or in any manner dealing with LR Bukhayo/Kisoko/6866 and 6867.
