Procedural Posture
Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time and Stay of Execution
Legal Issues
- 1 Whether the applicant should be granted leave to file a memorandum of appeal out of the statutory period.
- 2 Whether a stay of execution of the judgment and consequential orders should be granted pending the intended appeal.
- 3 Whether the applicant should be allowed to adduce new evidence in the intended appeal.
Ratio Decidendi
The court exercised its discretion to allow the applicant to file a memorandum of appeal out of time and granted a stay of execution of the judgment and consequential orders, subject to the applicant depositing Kshs. 10,000 as security for due performance of the decree. The court considered the respondent's concession to the application on the condition of security for costs and the applicant's circumstances, including visual impairment and representation on a probono basis. The orders were made to ensure fairness to both parties and to preserve the right of appeal, with costs to abide the outcome of the intended appeal.
Court Disposition
Application allowed in part, subject to conditions.
Orders
- Leave granted to file and serve memorandum of appeal out of time within 7 days.
- Applicant to deposit Kshs. 10,000 as security for due performance of the decree within 7 days, failing which the orders lapse automatically.
