The applicants did not present documentary evidence showing efforts to follow up with their former advocates or account for the time lapses. The court held that the length of the delay was inordinate and the explanations given were insufficient. The existence of an arguable appeal was not enough to warrant extension of time without a plausible and satisfactory explanation for the delay. Consequently, the court exercised its discretion against the applicants and dismissed the application for extension of time.
