However, the appellant failed to demonstrate that he would suffer substantial loss if the order for stay was not granted, as the IEBC had not yet gazetted the names of candidates and the appeal could be determined before the gazettement. The court held that the mere arguability of the appeal was insufficient to warrant a stay in the absence of proof of substantial loss. The issue of security for due performance was not relevant as neither party raised it. Consequently, the application for stay was rejected, and the parties were directed to fast track the appeal.
