Criminal Revision / Ruling on Application for Sentence Revision
Legal Issues
- 1 Whether the sentence of one year imprisonment for stealing from a dwelling house should be revised.
- 2 Whether community service is an appropriate alternative to imprisonment in the circumstances.
Ratio Decidendi
The court found that, although the applicant had a previous conviction and showed no remorse, he had already served six months of the one-year custodial sentence for stealing from a dwelling house. In the context of prison decongestion and considering the applicant's age (20 years), the court determined that the remainder of the sentence should be served as unpaid community service. The absence of a presentence report was noted, but the court exercised its discretion to revise the sentence to a non-custodial one, ordering the applicant to serve six months of community service at Siaya Police Station under supervision.
Court Disposition
Sentence revised from imprisonment to community service.
Orders
- The applicant William Ogwel Oduor shall be released from prison to serve 6 months unpaid community service at Siaya Police Station under supervision of the Officer Commanding Station.
- File closed.
