The High Court at Homa Bay lacks jurisdiction to entertain an application arising from a ruling in the Oyugis Principal Magistrate’s Court ELC case number 22 of 2022. Section 13(4) of the Environment and Land Court Act vests appellate jurisdiction over such matters in the Environment and Land Court presided over by a judge. The application was therefore filed in a court without jurisdiction. Following established legal principles, including the authority of the Lillian S case, the court must strike out proceedings where it finds it lacks jurisdiction. The preliminary objection raised by the respondent was sustained, and the application was struck out with costs to the respondent.
