The appellate court found that the suit before the Magistrate's Court was res judicata because it involved the same parties (or their privies), the same subject matter (land parcel Bassi/Bogetaorio II/238), and the same issues (validity of the respondents' claim to the land) as a previous suit (Kisii CMCC No. 92 of 2019), which had already been determined in favour of the estate of Kemunto Kenyanya. The respondents, having lost in the earlier suit, could not relitigate the same issues by purporting to act as administrators of the estate.
