The High Court held that its jurisdiction on appeal from the Small Claims Court is limited to points of law under Section 38 of the Small Claims Court Act. The grounds of appeal relating to apportionment of liability and the weight of evidence were found to be factual and thus outside the court's appellate mandate. The only arguable point of law was whether the quantum of damages was excessive. The court found that the trial adjudicator had not applied wrong principles nor made an award so inordinately high as to warrant interference.
