However, upon review of comparable authorities, the court held that the award of Kshs 180,000/- as general damages was excessive for the soft tissue injuries sustained. The court substituted the award with Kshs 125,000/- as general damages, finding this amount more consistent with awards in similar cases. The award of special damages was upheld as it was pleaded and proved. The appellant was awarded half the costs of the appeal.
