Ratio Decidendi

The Tribunal determined that it lacked jurisdiction to hear and determine the complaint because the 3rd Respondent's name had already been forwarded to the IEBC. According to binding Court of Appeal authority, once a party nominee's name is submitted to the IEBC, any dispute regarding the nomination process must be addressed to the IEBC, not the Tribunal. The Tribunal, therefore, could not consider the merits of the complaint or the eligibility of the 3rd Respondent, and was compelled to strike out the complaint for want of jurisdiction.
